Alex Shank
Alex Shank is an intellectual property attorney dedicated to helping companies of all sizes protect their brands and innovations. As a former Big Law litigation partner, IP transactional attorney, and federal appellate clerk, Alex has helped household names to fledgling start-ups tackle their thorniest IP issues, from the courts to the Patent & Trademark Office to the negotiation table. Alex's practice focuses on patent and trademark advocacy. In the patent space, Alex represents clients before the Federal Circuit and federal courts nationwide; litigates ex parte reexaminations, inter partes reviews, post-grant reviews, and other proceedings at the USPTO; provides opinions of counsel; and conducts patentability, landscape, and freedom-to-operate analyses. In the trademark space, Alex prepares and prosecutes trademark applications, litigates oppositions, cancellations, concurrent use, and other proceedings before the USPTO, and represents clients before the Federal Circuit and Trademark Trial and Appeal Board.
Alex's clients have included Fortune 500 companies and some of the biggest names in the biotechnology, pharmaceuticals, chemicals, materials, robotics, and computer networking industries, among others. For those clients, Alex has authored numerous briefs, motions, petitions, and other pleadings for IP owners and defendants in the Supreme Court, Federal Circuit, district courts, International Trade Commission, and U.S. Patent & Trademark Office, and has orally advocated in appellate, trial, and agency hearings. Alex has also taken and defended expert and non-expert depositions, including preparing expert and C-suite witnesses. Outside the courtroom, Alex has managed IP diligence in mergers, acquisitions, and licensing transactions and evaluated the coverage, validity, and registrability of clients' and their competitors' intellectual property.
Before launching The Shank Firm, Alex was a partner at Kirkland & Ellis LLP in Washington, D.C., where he represented IP owners and defendants in courts and agencies nationwide and gained special recognition for his advocacy before the U.S. Court of Appeals for the Federal Circuit. Alex also previously advised international life sciences innovators in million- and billion-dollar transactions at McNeill Baur PLLC.
